Damage is regularly being caused by vandals removing the fence slats that surround the Play Area. Repair of the fence is time-consuming and costly. The cost is borne directly by the Council Tax payers of Westwood.

In addition the screwed fasteners which secure the panels of the Multiplay are being removed. Some damage has been made as in some cases screw threads have been damaged which creates a problem in that replacing the missing screws with special stainless steel bolts that would be acceptable to health and Safety regulations may need an expensive custom made replacement.

The Parish Council takes a serious view of such incidents and Wiltshire Police have been informed.

5.       Westwood Road Safety.

a.       In the absence of Cllrs. Bishop and Richardson no report was given.

Clerk’s Note.

Cllr. Richardson sent the Clerk the following update on a number of road safety issues to be read out at the Parish Council meeting. Although it was sent prior to the meeting it was not received by the Clerk in time for the meeting. It is reproduced below (in italics) for information.

Questions asked and issues raised by Cllr. Richardson:

1.       One [large] area of Westwood which has hitherto received no material attention, is the residential highway network.

2.       Review what can be done to stop pavement mounting at the pinch point [narrow section at the junction of Orchard Close to the Westwood Social Club] on the C217, and the repair of the damaged pavement along that stretch.

3.       Review what traffic calming can be done on the C217 on the exit from the village in the direction of Freshford, on the sharp bend and junction to Iford.

4.       Reoccurrence of potholes due to water damage at various places on the C217.

5.       Condition, visibility and position of signage.

6.       Further traffic calming measures in Lower and Upper Westwood which compel self-enforcement without policing.

 Responses to the above from Stuart Renfrew, Wiltshire Council :

(1)   You are correct in your assumption that, unlike most of my parishes, Westwood is benefitting from a number of current interventions primarily along the main C217. The residential areas may suffer weed growth and minor loss of footway or road surfacing, all of which can be assessed against our intervention criteria with repairs scheduled accordingly. Other areas for consideration could be storm water drainage blockages, faded lining, dirty signage, overgrown highway trees and grassed areas etc. I can work through a list of Parish or Parishioner concerns independently for these areas and report back by mail once inspected if that would be easier.

 (2)   I would like to look at this with you as I remember the pinch point as being a give and take affair without recourse to mounting and damaging the footway. Additionally, only very minor ‘patch up’ repairs could be undertaken here without a full road closure, which it is always better to avoid.

 (3)   As a maintenance office we would not be involved in any new traffic calming proposals which should be routed through the CATG element of your Area Board having first secured Parish Council approval.

 (4)   As you are aware the route is to be surface dressed this summer and larger areas of damaged surface have already been patched in readiness for the overlay. In the week prior to the dressing, advance crews will be filling minor potholes and encroaching overruns along the road so as to create a level surface for the tar and chipping treatment. I will take a drive through to ensure that there are no serious holes in the meantime.

 (5)   We can wash existing signage or arrange for it to be renewed if it has lost its effectiveness through fading or damage. We can either look at such signs together or, as with the residential areas, I can work through a supplied list of sites. New signage requests or the re-positioning of existing signs can be dealt with by Dave Thomas’s team who’s contact details you already have.   

 (6)   As point (3).

End of Report.

In his report, Cllr. Richardson stated that the village walkabout with Stuart Renfrew is now proposed to take place on 18^th May.

b.       The Clerk tabled the questionnaire proposed by Wiltshire Council and gave copies to councillors for them to examine.

Cllrs. Harding and Biles commented that the questionnaire did not invite the respondent to state whether he or she supported the permanent implementation of the 20 mph limit throughout the village. Both councillors commented that this particular question was promised by Wiltshire Council and its absence from the questionnaire is counter to the agreement and understanding that the Parish Council had with Wiltshire Council. Cllr. Harding stated that Wiltshire Council had reneged on the deal agreed with the Parish Council at the outset of this 20 mph speed limit trial. Cllr. Biles insisted that this question must be put to the parishioners as promised otherwise it would be necessary for the Parish Council to promote a referendum in the village to gauge opinion because the parishioners also were expecting to be able to express their views about its permanent implementation. Councillors commented that the original ‘sample’ questionnaire had contained such a question.

The Clerk advised councillors of the content of an exchange of e-mails between Cllr. Richardson and Martin Rose (Wiltshire Council) in which Mr Rose has stated that his Service Director had specifically requested that this question be omitted fearing that the response from respondents would be for the permanent implementation of the new speed limit without them giving deeper thought to the matter that would be exposed by other less direct, but equally relevant, questions that the proposed questionnaire contained.

Councillors also expressed concern that there was an invitation on the questionnaire for respondents to reply online and that there would be no check as whether the online respondent was actually a parishioner or someone from without the parish or whether multiple online responses came from a single respondent. Councillors observed that such an abuse could greatly skew the results and be unrepresentative of parishioner’s views.

A lengthy discussion took place, and following a proposal by Cllr. Biles, the Council resolved that the omission of a simple ‘YES/NO’ question is raised as a matter of urgency and that Cllr. Richardson as the Parish Council’s delegated representative on the CATG is requested to take the matter up with Wiltshire Council as soon as possible.  The prevailing view of the Council was that a simple ‘YES/NO’ question regarding the permanent implementation of the 20 mph speed limit in Westwood must be included on the questionnaire.

6.       Neighbourhood Policing.

a.       In the absence of a member of the Neighbourhood Policing Team, no report was given’

b.       There were no other matters reported.

7.       Bradford on Avon Community Area Board.

a.       The Clerk stated that he had still not yet received a reply from the Area Board Chairman to the Council’s invitation to address the Parish Council on the role of the Area Board and that a further letter had been sent.

Councillors expressed the view that it was discourteous of Cllr. Hewson not to reply, even if such a reply was an acknowledgement of the original correspondence.

b.       In the absence of a Parish Councillor attending the Area Board meeting on 14 March there were no matters to be reported to the Council.

8.       Sub-Committees - Sub-Committee Reports.

Footpaths.

a.              Cllr. Johnston reported on behalf of the Footpath Sub-Committee. She stated that substantial work had been undertaken on Path WW19 in cutting down the hedges/trees on one side of the path. She added that she was aware of the concern of a parishioner regarding this matter but it would appear that the landowner was acting lawfully.

Cllr. Johnston also reported that a new ‘Footpath’ sign is required for the cemetery path because the original one had been broken and displaced.

Cllr. Edwards commented that he had taken photographs of a particular bad stretch of a bridleway, Path 20, that had potholes and was subsiding and had posted these on the website. He added that he will contact Wiltshire Council directly to request that immediate remedial action is taken.

Planning.

Cemetery.

a.       There was nothing reported from the Cemetery sub-Committee.

Cllr. Higgs reported that there were gaps in the hedge that runs alongside the path to the cemetery and the effect of this is that it disrupts the privacy and solitude hitherto provided to mourners and other visitors walking to the cemetery. She suggested that planting of additional laurel bushes would restore the hedge to its original condition. The Council resolved that this action be taken and asked the Clerk to obtain three quotations for this work to be undertaken and to present these to the Parish Council at the next meeting for a decision to be taken.

Cllr. Harding commented that the compost heap in the far corner of the cemetery is an eyesore and some thought should be given to removing or shielding it.

b.       The Clerk stated that there had been an recent exchange of correspondence between Mr Azis, a churchwarden and Wiltshire Council on the subject of the responsibility for the closed churchyard but that the main issue of restoring the grant had not been resolved.

c.       The Clerk stated that he had approved an application for an interment in the Remembrance Garden and that the appropriate fee – in this case a ‘double fee’ because the deceased had no connection with Westwood – would be remitted to the Parish Council.

Finance.

a.       The Clerk reported the current financial position – details of which are appended to these minutes.

The Clerk stated that he had completed the Annual Return for FY2011/12 and that everything was in order with the accounts balancing and full reconciliation of the bank accounts with the Cash Book. He added that the Internal Auditor will be invited to undertake the Internal Audit and thereafter the Annual Return will be presented to the Parish Council for approval.

b.       The Council resolved to make the payments shown under ‘Payments to be authorised’ above.

Open Spaces.

a.              Cllr. Edwards reported on behalf of the Open Spaces Sub-Committee and commented that there was nothing significant to report. Cllr. Harding reported that he had inspected Westwood Park and can confirm that the palings are still missing from the Play area fence, although in a discussion with Mr Say, Mr Say had confirmed that he will be replacing the missing palings in the near future. Cllr. Edwards stated that he has still to find a source for the security bolts for the play equipment.

b.              Cllr. Edwards stated that there was nothing to report with respect to the Play Area.

 Environment.

a.       In the absence of Cllr. Richardson there was nothing significant to report from the Environmental Sub-Committee.

b.       Cllr. Johnson asked if there had been any further news regarding the ‘unauthorised’ parking bay that had been created near to Staples Hill. The Clerk stated that he had received confirmation from Wiltshire Council that the person involved had been told to restore the area to its original condition but that nothing further had been heard.

Cllr. Johnston reminded the Clerk that he had been requested to obtain ‘No Dogs’ signs for the Westwood Park Play Area.

Cllr. Biles enquired whether Wiltshire Council had replied to the enquiry made by the Parish Council regarding the drainage ditches along Lyefield Lane. The Clerk stated that he had not received a reply and would contact Wiltshire Council.

The Clerk reported that he had been in regular contact with Norman Burgess, Wiltshire Council regarding the installation of a new waste bin, also suitable for dog waste, near to Westwood Manor. He added that he was hopeful that the bin would be installed soon.

Cllr. Edwards confirmed that he had received the report on the work undertaken by the Parish Steward from Denise Grech, Wiltshire Council. He added that some of the work that he had requested had not been undertaken and that he had repeated the request for the next visit of the Steward.

Cllr. Biles reported that weed spraying at The Pastures had still not been undertaken despite several assurances from Wiltshire Council that it would be done.

The Clerk drew the attention of the Parish Council to the following:

·    The date of the Annual Parish Meeting:  Tuesday 24 April 2012. There ensued a brief discussion on the proposed speakers.

Cllr. Howard-Evans stated that the current edition of the Westwood Update is No. 96 and noting that the 100^th edition is likely to be around Christmas, he suggested that some form of celebration for those involved in its production and distribution may be appropriate. The Clerk was asked to place this subject on the Agenda for the next meeting.

Cllr. Harding observed that vehicle drivers appeared to be having difficulty dealing with the appearance of a Virtual Pavement and he had met vehicles head-on that were treating the Virtual Pavement as a ‘no-go’ zone even in the absence of pedestrians using it.

Cllr. Johnston confirmed that she shared Cllr. Higg’s view that some form of guidance to road users was necessary in respect of the use of a Virtual Pavement.

The Chairman welcomed Helen Lines and Caroline Metz from ‘Wiltshire Good Neighbours’ – an enterprise jointly supported by Wiltshire Council, Community First, Wiltshire age UK and Salisbury District age UK. Ms. Lines gave a presentation on the role and responsibilities of ‘Wiltshire Good Neighbours’ and commented that the main purpose of the scheme was to empower older and vulnerable residents to access the services, information and support they need to live safe, comfortable, fulfilling and independent lives. She introduced Caroline Metz as the local (Westwood) coordinator for the ‘Good Neighbour’ scheme.

Parish councillors expressed their support for the ‘Good Neighbours’ scheme and invited Ms. Lines to provide information on the scheme that could be placed on the website and in the Westwood Update.

A Question and Answer session followed at the conclusion of which the Chairman, Cllr Parker, thanked Ms. Lines for her presentation.

5.       Westwood Road Safety.

a.       Cllr. Richardson stated that the road works to improve the state of the classified roads through Westwood had now been completed during the period 22 – 28 February and he commented that except for one or two relatively minor matters the work had been completed to a high standard. He added that he had raised a query about the stretch of road from the tree-lined single lane [west side] to Downside Nurseries, which has not been repaired.

He reported that the ‘white-lining gang’, including painting the virtual pavement, are scheduled for 7 March and that resurfacing is still planned for June / July, after which the white-lining, including the virtual pavement, will be repainted.

Cllr. Richardson stated that he had attended the CATG Meeting that afternoon and that additional works for Upper Westwood, costing £538, have been approved and funded by the CATG.  He commented that he had raised query about the date of works, which was to include signage and white-lining for the Westwood Nursery School area.  He observed that other works which require legal permissions, such as moving the speed derestriction sign from the start of the tree-lined single lane to the other side of Downside Nurseries, will be revisited at the time of making a Traffic Order for the permanent implementation of the 20mph speed limit, if that is agreed.

He reported that other points emerging from the CATG Meeting were:

·    The total budget of £25K for this fiscal year had been committed.  The budget for 2012 - 13 is £10,602, and expectations of substantial further funding for Westwood should be lowered, unless Westwood Parish Council make financial contributions towards the work.

·    Along with the C213 at Monkton Farleigh, and the C225 from the A36 to Midford, the C217 from Cock Hill, Trowbridge through to the A36 are to be considered for a total C road speed review.  The 20mph trial in Westwood will not exclude the C217.

·    Outstanding traffic calming and road improvements will need to be reviewed and updated, and revised requirements resubmitted to the CATG for their June meeting.  Cllr. Richardson suggested that a meeting of the Westwood Road Safety Group is convened to carry out the review.

·    The 20mph survey questionnaire is being finalised and it is estimated that it will be sent out towards the end of this month.  However, the Parish Council has raised some concerns regarding its wording and emphasis which will be forwarded to the Wiltshire Council coordinator, Martin Rose.

·    After completing the remaining metro counts at the other 20mph sites and following the analysis of all the survey results a report is to be published in the Summer.

The Chairman thanked Cllr. Richardson for his report. Cllr. Richardson stated that Mr Dave Thomas at Wiltshire Council had been particularly helpful and supportive in the implementation of these road safety improvements at Westwood and, following a proposal from Cllr. Richardson, the Council resolved unanimously to write a letter to the Wiltshire Council Service Director for Highways, Mr Parvis Khansari expressing its appreciation of the work undertaken by Mr Thomas..

Cllr. Howard-Evans stated that he still supported some form of footway utilising the existing grass verge at the Iford end of the village and was very disappointed that this matter had not been included in the work programme to be implemented at Westwood. Cllr. Richardson commented that a great deal had been achieved  but the programme would be one of continuous improvement and requests for this footway work would be submitted to the Wiltshire Council CATG in due course.

Cllr. Higgs congratulated all those concerned in improving the appearance of the village and for making it a safer place to live.

b.       Councillors decided that it was premature to assess whether the ’20 mph Speed Limit’ should be made permanent and that a more informed decision could be made following the completion of the trial, publication of the metro count survey results/analysis and knowledge of the feedback from the Survey Questionnaire. The Clerk was asked to place this matter on the agenda for the September Parish Council meeting.

c.       Discussion on possible additional road safety measures for Westwood was deferred until a subsequent meeting.

d.       The Chairman observed that the proposed Community Survey questionnaire had only been received by some councillors. A sample questionnaire was tabled and circulated to all councillors. Notwithstanding that, and also bearing in mind that it was to be a generic questionnaire equally applicable to the five trial sites, he considered that some of the wording could be improved and that better ‘tick boxes’ could be provided that required some thought to be exercised by the respondents when completing the questionnaire. He invited all councillors to forward any comments to him and he stated that he would liaise with Cllr. Richardson when responding to Wiltshire Council, David Rose.

6.       Neighbourhood Policing.

a.       In the absence of a member of the Neighbourhood Policing Team, no report was given’

b.       There were no other matters reported.

7.       Bradford on Avon Community Area Board.

a.       Cllr. Bishop reported on behalf of the Cemetery Sub-Committee.  He stated that it appeared in good condition, although the path to the cemetery between the two gates must be kept cut back – especially in the area of the privet hedge – to allow access for the bier.

b.       The Clerk stated that he had no more information regarding the Closed Churchyard/Cemetery. Cllr. Harding commented that the longer this matter continues the less likely it would be that Wiltshire Council would pay the Cemetery Grant.

c.       The Clerk stated that he had approved an application for an interment in the Remembrance Garden and that the appropriate fee had been paid

Finance.

a.       The Clerk reported the current financial position – details of which are appended to these minutes.

b.       The Council resolved that the signatories for the National Savings Westwood Park Fund were to be the same as those for the other Westwood Parish Council Bank accounts, namely Cllrs. Parker, Bishop and Johnston.

c.       The Council resolved to make the payments shown under ‘Payments to be authorised’ above.

Open Spaces.

a.              Cllr. Edwards reported on behalf of the Open Spaces Sub-Committee and commented that there was nothing significant to report.

b.              Cllr. Edwards stated that there was little to report with respect to the Play Area and that seven fencing slats remain missing from the Play Area fence. He commented that the new surface near the gate to the Play Area had now been installed and added that there was no additional graffiti to be seen.

Cllr. Johnston reported that a parishioner had observed a dog in the Play Area that appeared to belong to one of the adults who was supervising a child in the Play Area and that a number of fag ends had been discarded there also. The Clerk was asked to obtain a couple of ‘No Dogs’ signs to be erected at the Play Area.

The Clerk confirmed that Neville Day had undertaken the husbandry of the trees in Westwood Park.

C.      Cllr. Bishop reported that he had received a request from Trowbridge Rangers Football Club to have the use of the Playing Field for their matches. There ensued a discussion on the effect on the condition of the Football Pitch resulting from the increased of this Playing Field if such a request was granted, the need for additional line marking, increased traffic and the possible noise nuisance to neighbouring properties if football matches are played on both Saturday and Sunday. Councillors also commented that it was a local village Playing Field and its use should be restricted to local village clubs, such as Westwood United Football Club.

The Council resolved to refuse the request. Cllr. Bishop stated that he would write to Trowbridge Rangers Football Club.

Cllr. Bishop relayed a request from a parishioner to the Council regarding the use of the Playing Field on 26 May 2012 for a Westwood School PTA sponsored Football Tournament to raise funds for the school. The parishioner had also requested that temporary access between the school and the Playing Field be created – subject to it being restored to its original condition after the tournament.

The Parish Council resolved that the Playing Field could be used for that purpose and that temporary access could be created. Cllr. Bishop agreed to inform the parishioner.

 Environment.

a.       In the absence of Cllr. Richardson there was nothing significant to report from the Environmental Sub-Committee.

b.       Cllr. Edwards reported that the Parish Steward had been requested to complete any tasks that remained outstanding from his previous visit, including weed-spraying. Councillors identified potholes in Boswell Road and in Hebden Road as needing attention.

The Chairman asked that the website be used to invite parishioners to suggest tasks for the Parish Steward and that a similar note be placed in the Westwood Update. Cllr. Edwards stated that he would investigate how the website could be used and that he would contact the Newsletter editor.

c.              Clerk’s Note.

This item was taken early in the meeting (at Agenda item 5) whilst Cllr. Richardson was present.

The Clerk stated that Stuart Renfrew, Wiltshire Council, Highways Dept. had requested a ‘parish contact’ be nominated so that he could ‘walk the highways’ in Westwood to identify any additional tasks that needed to be undertaken that were outwith the remit of the Parish Steward. Cllr. Richardson offered to be that contact. The Clerk was asked to pass these details to Mr Renfrew.

Footpaths.

a.      Cllr. Johnston reported on behalf of the Footpath Sub-Committee and stated that there was nothing significant to report.

b.      The Clerk invited the Parish Council to decide whether it wished to accept the offer from the Footpath Warden and to have a ‘kissing gate’ installed at the junction of Paths 7 and 8. Councillors discussed this matter at length, observing that these footpaths had many stiles on them and a single ‘kissing gate’ at this junction would not make any significant difference to the accessibility of this part of the countryside. The Council resolved not to request the installation of a ‘kissing gate’.

c.      The Council noted the Footpath Diversion Order (Path 38).

9.       Wiltshire Core Strategy Consultation – ends 2 April 2012.

The Council resolved that it had no comments to send to Wiltshire Council.

10.     The Queen’s Diamond Jubilee Celebration 2012.

In the absence of Cllr. Biles no report was given but it was noted that Cllr. Biles is to attend the next meeting of the Jubilee Celebration Committee.

Cllr. Parker tabled a poster advertising the ‘Wine and Cheese’ fundraiser to be held at The Old School House on 14 April 2012.

11.     Westwood Update – Newsletter.

a.       The Council considered a request from a parishioner to include commercial advertising on the Westwood Update and following a discussion on the merits or otherwise of this request the Parish Council resolved that the Editorial Policy would remain unchanged i.e. that there would be no commercial advertising in the Westwood Update.

b.       The Editorial Policy Issue 1, dated 6 December 2004 was reviewed and the Council resolved to amend it as follows:

Delete Policy, Paragraph 9 and renumber existing paragraphs from 1 to 11 inclusive. This paragraph related solely to the reproduction cost of the Newsletter.

Clerk’s Note.

The Editorial Policy document is now ‘Editorial Policy Statement, Issue 2, 5 March 2012.

12.     Mobile Library.

The Clerk stated that Wiltshire Council is undertaking a consultation on the proposed routes and timings of the Mobile Library visits and that the consultation ends on 11 May 2012. The Clerk was asked to include this matter as an Agenda item at the next meeting to allow councillors to sound out the views of parishioners.

13.     Valley Parishes Alliance (VPA).

Cllr. Parker reported that he had attended the meeting of the VPA held on 9 February and gave the following report (shown in italics) that he read out at the meeting:

·         The VPA website is fully up and running now – can be accessed at -www.valleyparishesalliance.org.uk.

·         The position paper on canals was submitted to British Waterways in December

·         Andy Thomas and Cleo Newcombe-Jones from BANES council made a presentation regarding the localism bill. Banes have held focus groups and Parish events. There are 3 main aspects.

o        Neighbourhood development orders

Neighbourhood development orders would allow Parishes – to get some things set up without the need for planning e.g. solar panels – the right to build e.g. car parks and community facilities – small scale development that has local support

o        Neighbourhood plans

This is planning focussed and is a permissive tool to enable Parishes to plan some future developments that the parishioners want e.g. affordable housing, old peoples housing, renewable energy, visionary policies. It is aimed at enabling Parishes to help shape local planning and become more involved in planning.

Freshford and Limpley Stoke are going ahead with a cross border application for a neighbourhood plan and have received funding to do so as a pilot, 150 people attended a meeting to launch it.

Neighbourhood plans do not replace Parish Plans.

They will have teeth and can put elements into planning that that the parish wants to include or exclude from higher level plans.

For plans for building, etc, the parish will need to hold a referendum where a majority votes for it.

There are summary guides on the BANES website and CPRE have a guide on their website.

o        Community rights to buy

This is to enable parishes to have the right to challenge the sale of community assets and to have time to raise funds to purchase such assets. This is to stop community assets, such as pubs, shops, post offices,  etc being sold off for other uses without the community having the chance to buy. With this in place parishes can say that they want to bid and there will be a 6 month period where a full bid to buy can be made. The owner does not have to accept the bid.

To activate this parishes must produce a list of properties that are assets to the community, there will then be a review period and an appeals process if owners do not want the property to be on the list. ( Note: maybe for Westwood we should consider the pub, the shop/post office, the social club, the parish hall, ........)

Parishes can put green spaces on this list. Council owned property can also be on the list.

o        Community rights to challenge

Where the council provides a service in a parish which the parish believes can be provided better by another method (not a private company)then the parish can challenge the council and the council has to have a very good reason to refuse the challenge.

·         Transport

There is a meeting in March with the Highways agency to discuss the traffic situation  and safety measures on the A36. The minister of transport sent a letter saying that a survey will be undertaken this year. If funding is available the results may be implemented next year.

·         BANES core

There has been an encouraging meeting with BANES to discuss the plan and the disagreements that various organisations had with it. E.g. affordable housing – do Parish Councils have the right to check that tenants have local links.

BANES have put their amendments to the core strategy plan on their website.

·         Gypsies and travellers

There will be a new consultation by BANES in June on specific sites for travellers.

·         Kennet and Avon

British Waterways are expected to produce recommendations in a couple of weeks on the recent representations.

The VPA will probably be invited to have a representative on the Partnership Board for the canal.

BANES are trying to put “water dwellers” into the gypsies and travellers group as they think British Waterways will marginalise them.

14.     Date of Parish Council Meeting.

a.       The Council noted the date of the next Meeting:

b.       The date for the Annual Parish Meeting was agreed – Tuesday 24 April 2012.

The Clerk drew the attention of the Parish Council to the following:

·         Wiltshire Council letter – ‘Fracking Operations’. This was a reply to the letter to Wiltshire Council from the Parish Council.

·         Wiltshire Council letter – ‘Waiting Restrictions Consultation’. This letter extended the deadline for consultation responses to the end of April.

Cllr. Edwards reported that ‘Climate Friendly – Bradford on Avon’ had suggested a ‘Litter Pick’ should be undertaken in the village. It was agreed that this subject be included as an Agenda item at a subsequent meeting.

Cllr. Higgs stated that the introduction of a ‘Virtual Pavement’ in the village should be accompanied by guidance to road users advising them of any protocols regarding their use. She added that confusion regarding their use was evident at Limpley Stoke and she wished to avoid a similar situation at Westwood.

The Chairman welcomed everyone to the meeting.

2.       Apologies.

3.       Minutes of the Ordinary Parish Council Meeting held on 9 January 2012.

The minutes of this meeting were signed as a true and accurate record.

4.       Adjournment.

In the absence of any members of the public, the meeting continued without an adjournment.

5.       Westwood Road Safety.

a.       Cllr. Richardson stated that the proposed schedule of road safety improvements had been published in the Westwood Update and the first action is for repairs to be made to the carriageways – especially at Lower Westwood. He commented that two additional metro-counts are to take place at each of the four sites following the installation of the virtual pavement and following the later addition of further signage in order to give a sound statistical basis for judging the effectiveness of the various safety measures.

Cllr. Richardson reported that the recent site survey with David Thomas (Wiltshire Council) was particularly productive and a provisionally agreed list of additional safety measures was produced, all of which represented low cost /quick fixes and able to be financed from the increased CATG/Wiltshire Council  Budget of £25,000. He added that the reason for a number of existing road signs, such as the weight restriction signs, was historical and when the Traffic Orders were published to confirm the 20 mph limit – assuming that this was the final decision – then all existing signage would be reviewed and any changes included within the order.

Cllr. Richardson concluded his report by stating that the next CATG meeting is to be held on 5 March and it would be very helpful to review the list agreed with David Thomas before then to enable the CATG to endorse the proposals.

Cllr. Harding expressed concern that one or two of the 20 mph signs at Upper Westwood were badly positioned. Cllr. Richardson replied that he was aware of this, especially in relation to the signs at Chestnut Grove and that they will be improved as part of the road safety programme.

b.       Councillors noted and generally supported the proposed road/pedestrian safety measures detailed in the report of the site visit tabled by Cllr. Richardson.

Cllr. Harding commented that a decision had been made by the Parish Council at a previous meeting not to have a pavement at the Iford end of the village but, instead, to create a footway on the existing grass verge. This view was supported by other councillors.  Cllr. Richardson noted this for future reference.

c.       The Council resolved that no additional ‘dropped kerbs’ were required in the village.        

d.       Cllr. Richardson and the Clerk commented that a recent consultation request in relation to ‘waiting restrictions’ had given the Parish Council inadequate time to respond and that to impose such tight and unrealistic timescales was totally unreasonable. The Clerk commented that the argument presented by Wiltshire Council that a Parish Newsletter had been the ‘authority’ for requesting comments from the Parish Council was specious.  He stated that the Parish Newsletter is simply a source of information and cannot be considered a formal communication with a Parish Council – a view that Cllr. Richardson stated was fully supported by the Trowbridge Council Town Clerk. Cllr. Richardson added that formal communications, especially those involving either statutory or voluntary consultation with Parish Councils, must be by means of a formal letter addressed to the Clerk.  This would also apply to comments made at the CATG, even if minuted, where local support and action is required.  He continued that the issue is compounded by demands made for answers in short timeframes (by the service provider) when compared to requests made by or responses to letters from Parish Councils (the customer) which are often late, even after several reminders from the Clerk. 

The Council resolved that the Clerk writes a letter of complaint to Wiltshire Council and pointing out that the Parish Council will respond to consultation requests at an appropriate time based on its meeting schedule.

  The Council confirmed that it had no comments to make in respect of the ‘waiting restriction’ consultation.

6.       Neighbourhood Policing.

a.       PC Barrett reported that there was little to report except for a break-in at Iford Manor where power tools had been taken from an outbuilding. He added that a spate of thefts from insecure cars had occurred in a nearby parish and he reminded everyone to properly secure their vehicles when leaving them unattended.

Cllr. Harding reported that the manager of the Nursery School had commented to him that a taxi driver was regularly driving at a high speed in the vicinity of Chestnut Grove. In reply to a question from Cllr. Harding, PC Barrett confirmed that he was currently unable to issue Fixed Penalty Notices for motorists exceeding 20 mph, but it was possible that there may be changes to this policy.

Cllr. Bishop stated that PCSO Huntley had been given details of a suspicious vehicle seen in Lyefield Lane. PC Barrett said that he was aware of this but the vehicle and occupants were lawfully employed.

There were no other matters reported.

7.       Bradford on Avon Community Area Board.

a.       The Clerk stated that he had not yet received a reply from the Area Board Chairman to the Council’s invitation to address the Parish Council on the role of the Area Board. The invitation to the ‘Local Knowledge – Local Action’ event that had been extended to the Chairman and others was noted and addressed under Agenda item 10.

b.       Cllr. Biles reported that the Olympic Torch was travelling through Bradford on Avon on 22 May and there was a general expectation by the Community Area Board that nearby villages would organise and participate in a series of celebratory events. He added that there also appeared to be an expectation that inter-village competitions and other events would take place between the Olympic Torch relay and the Queen’s Diamond Jubilee celebrations.

Cllr. Biles stated that he had resigned from the Grants Committee that was formed to vet Community Area Grant applications because the recommendations of the Grants Committee were regularly ignored by the Community Area Board and he considered that many of the grant applications subsequently granted did not merit consideration. He added that other members of the committee had also resigned for the same reason.

d.              Cllr. Bishop stated that he had researched the background to Neighbourhood Plans and how they

are to be developed and approved and he gave a short presentation on his findings. The Clerk stated that he had received a reply from Wiltshire Council (Jane Scott) to the letter from the Parish Council seeking more information on Neighbourhood Plans. He read out the main points of the letter to the Council and commented that the best opportunity to learn more about Neighbourhood Plans would be at one of the ‘informal meetings’ to be held by Wiltshire Council alluded to in Jane Scott’s letter.

Councillors queried the purpose and value of such plans, especially if they are to be subjected to such a tortuous approval regime and argued that many of the proposals to be contained with a plan are already addressed by the Parish Council on a regular basis.

e.       There were no other planning matters.

Cemetery.

a.       There was nothing to report from the Cemetery Sub-Committee. The Clerk stated that he had approved an application for an additional inscription on a memorial and that the appropriate fee had been paid.

b.       The Clerk stated that he had no more information regarding the Closed Churchyard/Cemetery.

Finance.

a.       The Clerk reported the current financial position – details of which are appended to these minutes.

b.       The Council resolved that the tender for the grass cutting from S&J Grounds Ltd be accepted. It was agreed that the offer of additional cuts would not be taken up.

c.       The Council resolved to make the payments shown under ‘Payments to be authorised’ above.

Open Spaces.

a.       Cllrs Harding and Edwards confirmed that there was little to report and that some six or seven fencing slats remain missing from the Play Area fence.

Cllr. Biles confirmed that Neville Day had undertaken an inspection of the trees in Westwood Park and had submitted a report. Cllr. Biles summarised the report for the Council, following which the Council resolved to invite Mr Day to provide a quotation for undertaking the work

Cllr. Johnston commented that the tree in Westwood Park that had been cut was in a generally poor condition. It was agreed that Mr Day should include this tree in his schedule of work and Cllr. Edwards offered to remove the existing cut branches from the park. It was also agreed that Mr Cooke be asked to remove the cut branches and other arisings from the rear of the Social Club that resulted from the action taken recently by Cllr. Johnston to clear an obstruction.

b.       There was nothing to report in respect of the Play Equipment inspection for January. The Council noted the revised quotation of £450 from Playforce for laying new mat at the entrance of the Play Area.

Environment.

a.       Cllr. Richardson reported on behalf of the Environmental Sub-Committee. He stated that he had been contacted by a representative from Climate Friendly Bradford. He added that he had advised the representative to write to the Clerk.

Cllr. Biles commented that a parishioner had raised the subject of the ditches running down Lyefield Lane and that he had learned from the Clerk that it would be a mammoth task to clear them, even though it was generally agreed that, if cleared, they may alleviate some of the flooding on the Lower Westwood road. Cllrs. Howard-Evans and Richardson each commented on their very poor overgrown condition and it was agreed that the first step would be to ascertain who owns the ditches. The Clerk was asked to contact Wiltshire Council for information.

Councillors reported that the Grit Bin at Staples Hill had been badly damaged and required replacing.

b.       Cllr. Edwards reported that the Parish Steward had been requested to undertake a number of tasks on his earlier visit, although he could not confirm that they had been completed. He commented that on his second visit in January he was asked to fill some deep potholes and Cllr. Johnston stated that she had seen him undertaking this task.

Footpaths.

Cllr. Johnston reported on behalf of the Footpath Sub-Committee and stated that clematis was overhanging Path 16.

Cllr. Johnston stated that she had walked Paths 7 and 8 following the invitation to the Parish Council from the Footpath Warden for him install new ‘kissing gates’ on that route. Cllr. Johnston presented a marked-up map indicating where such a gate, or gates, could be installed. The Clerk was asked to discuss this proposal with the Footpath Warden and to make recommendations to the next Parish Council meeting.

Cllr. Biles stated that a new Dog Bin near to Westwood Manor was a necessity and that the National Trust would support this proposal. The Clerk was asked to contact Wiltshire Council.

9.       The Queen’s Diamond Jubilee Celebration 2012.

Cllr. Biles stated that there are a number of activities planned for this Celebration, including a Picnic in the Park, a Walk and Cream Tea, a lighted Beacon on the Church Tower and various sports.  He added that approximately eighty Jubilee Mugs will be required for presentation to the children.

Cllr. Parker stated that he was sponsoring a Cheese and Wine event at his house in support of the Jubilee Celebrations and he tabled an advert for the event designed by his wife. Cllr. Edwards was requested to place it on the Westwood Website.

10.     Local Knowledge – Local Action.

Cllr. Richardson stated that this was an event sponsored by the Community Area Board to garner thoughts and opinions from local individuals and communities on a wide range of topics that had been addressed in a recently published document entitled ‘Joint Strategic Assessment’ and that it was to be held on 23 February 2012. He added that a number of councillors, including the Clerk, had been invited to attend. Cllr. Biles stated that he would be attending.

11.     Neighbourhood Plans.

This item was covered under Agenda item 8d above.

12.     Valley Parishes Alliance (VPA).

Cllr. Parker reported that the next meeting of the VPA is to be held on 9 February and that he would be attending on behalf of the Parish Council.

The Chairman reported that a parishioner had enquired whether the Westwood Update advertising supplement could be published more often than annually. Councillors considered this request and decided that it should remain an annual supplement and that the policy of the Council not to accept commercial advertising for the bi-monthly issues should remain unchanged.

The Clerk advised the Parish Council that Wiltshire Council had sent the Parish Council a DVD to encourage more parishioners to put their name forward as possible parish councillors. He added that as the next elections are in May 2013, this campaign was particularly timely. Cllr. Johnston took the DVD to examine.

4.       Westwood Nursery School.

a.       Alex Clark and Belinda Lawrie, respectively the Chair and Secretary of the Westwood Nursery School Management Committee, gave a presentation on the future of the Nursery School and the proposal, yet to be confirmed, of moving from its present site to a refurbished room at Westwood Primary School, Boswell Road. Ms. Clark stated that the possible move was prompted by a reduction in the Nursery School roll, the necessity to effect cost savings and the synergy that already exists between the two schools – the latter being the school of choice for most Nursery School children. She added that this possible move was strongly supported by the Headteacher and Governing Body of Westwood Primary School and by the Nursery School Management Committee and that a decision whether to move had to be made by 31 March 2012 in order to secure funding to support the move. Ms. Clark added that if the move did proceed then the Nursery School would open at the Westwood Primary School site with effect from September 2012.

The Parish Council expressed its full support for the Nursery School and that it applauded any actions that would ensure its survival because it was an important and much valued facility within the village

Cllr. Harding counselled against the possible move arguing that the independence and separate identity of the Nursery School would be lost and that any gains by combining with the Primary School were purely illusory. He added that the current problems of car parking near to the Primary School would also be exacerbated. Cllr. Richardson proposed that the Nursery School Management Committee ask to have sight of the Westwood Primary School Travel Plan to ensure that any additional traffic arising from the possible move can be safely accommodated.

Cllr. Richardson offered, and was nominated, to be the link between the Nursery School and the Parish Council regarding the possible move in order to alert the Parish Council to take any necessary action to protect the existing Nursery School building should it become vacant, as it was a Parish Council asset.

The Clerk stated that whilst the Parish Council fully supported the continuance of the Nursery School it also had to recognise that the existing Nursery School building at Westwood Park could only be used for ‘community purposes’ should it become vacant. He added that seeking an alternative use for that building could prove difficult.

b.       The Parish Council decided that no action be taken at present to investigate other uses for the existing Nursery School building.

5.       Adjournment.

In the absence, at this point, of any members of the public, the meeting continued without an adjournment.

6.       Westwood Road Safety.

a.       Cllr. Bishop reported that there was now a timetable for the road safety works to be implemented and in view of the recent CATG Meeting, he invited Cllr. Richardson to give a report.

Cllr. Richardson stated that he had that afternoon attended the CATG Meeting and commented that there was now an agreed schedule of works for the road safety measures to be implemented. He gave the following details:

b.       Cllr. Richardson stated that in addition to the matters already reported the following were raised at the CATG Meeting:

·    Upper Westwood is to be subject to a site survey with a view to introducing additional road safety signage and that the funding for this is to be met by the extra £25,000 made available to the Area Board.

·    All Parish Councils are to be asked to provide a list of any additional signage that they consider necessary to improve road safety in their respective villages.

·    New ‘Sat Nav’ road traffic warning signs are to be installed locally to warn HGV drivers of the unsuitability of certain roads for Heavy Goods Vehicles. Councillors questioned the effectiveness of such signs and Cllr. Edwards suggested that a more effective means of preventing HGVs from using unsuitable roads was to insist that the HGV drivers utilised the appropriate Sat Nav software package specifically designed for HGVs.

·    Wiltshire Council is to write to all Parish Councils enquiring whether additional ‘Dropped Kerbs’ are required.

·    The next CATG Meeting is to be held in March.

Councillors queried whether the wording of the proposed questionnaire had been agreed. Cllr. Richardson stated that Wiltshire Council was keen to have a set of generic questions suitable for each of the six ’20 mph Speed Trial’ areas and that a draft questionnaire was still in preparation. Councillors noted that Cllr. Parker was devising possible questions for consideration. Cllr. Bishop was requested to obtain the timetable for the production of the questionnaire and to contact Cllr. Parker to establish whether he was still involved in assisting in its production.

7.       Neighbourhood Policing.

a.       In the absence of a representative from the Neighbourhood Policing Team, no report was given.

b.       Cllr. Harding reported that a newly occupied property in Boswell road had resulted in the parking of five additional cars at the kerbside. He commented that this was particularly anti-social and enquired whether any action could be taken. Councillors replied that it was a public road and if the cars were taxed and insured then no action could be taken. The Clerk commented that if a ‘car sales’ business was being operated from the kerbside then Wiltshire Council may take an interest. Cllr. Harding was advised to contact the NPT and to report the matter.

There were no other matters reported.

8.       Bradford on Avon Community Area Board.

a.       The Clerk stated that he had not yet received a reply from the Area Board Chairman to the Council’s invitation to address the Parish Council on the role of the Area Board. He commented that there did not appear to be overall support from the other rural parishes to examine more closely the role and constitution of the Area Board.

b.       There were no matters that the Parish Council wished to have raised at the forthcoming Area Board meeting.

He also reported that he had advised Wiltshire Council of the car parking space, including the laying of a hardstanding, that had been created along the road towards Staples Hill and that Wiltshire Council had confirmed that it is investigating the matter.

e.       The Clerk advised that an appeal is to be held in respect of planning application W/11/01632/FUL, 50 Farleigh Lane. The Council resolved to send comments to the Appeal Inspector supporting the proposed development.

The Clerk tabled the following document: ‘CPRE/WALC – Planning Explained’ and handed it to Cllr. Bishop for retention.

Cemetery.

a.       Cllr. Harding reported that following the high winds there is a lot of debris on the cemetery paths. The Clerk stated that he would ask Mr Cooke to clear it away.

b.       The Clerk stated that he had progressed this matter and that the Churchwardens and the Parochial Church Council (PCC) were active in seeking a solution, especially as Wiltshire Council now claimed that the maintenance of the closed churchyard is entirely the responsibility of the PCC. The Clerk added that Jonathan Azis, one of the Churchwardens and a solicitor, was now intending to write to Wiltshire Council challenging its view. The Clerk added that he would keep the Parish Council informed of developments.

Finance.

a.       The Clerk reported the current financial position – details of which are appended to these minutes. He added that the Interest on the National Savings Account for 2011 was £15.58.

b.       The Council resolved that the Office Allowance for the Clerk be £200, an increase of £25. The Clerk thanked the Council for this increase.

c.       The Council resolved that the Budget, as shown appended to these minutes, be adopted and it further resolved that a Precept of £10,500 be requested

d.       The Council resolved that S&J Grounds Ltd be invited to submit tenders for undertaking the Open Spaces Maintenance for FY2012/13. Two tenders are to be requested; one in accordance with the current specification, the other to include the removal of the cut grass.

e.       The Clerk stated that the quotation from Playforce for a new pathway in the Play area was £585.08. Councillors commented that this was excessive and the Council resolved that a maximum of £450 be expended on this project and invited the Clerk to use his best endeavours to obtain a lower quotation.

f.        The Council noted the contents of the two letters received from Mr Parsons of Westwood Post Office and Stores for a donation towards the cost of improving the lighting in the shop. The Council discussed this request at some length, especially in relation to the value of the shop and Post Office to the village community. The Parish Council resolved not to make a donation on the basis that it would be an inappropriate use of limited public funds to support a purely commercial enterprise. The Clerk was asked to write to Mr Parsons explaining the reason for denying his request but emphasizing the value that the Parish Council places on the existing of the shop and Post Office and his unremitting efforts to make a success of the business.

g.       The Council resolved to make the payments shown under ‘Payments to be authorised’ above.

Open Spaces.

a.       The Parish Council noted the correspondence from a parishioner regarding the use of the Playing Field for football practice and agreed to its use for that purpose. Cllr. Bishop agreed to contact the parishioner and to inform him of the decision and to address one or two other concerns that he had expressed in his correspondence to the Parish Council.

The Council confirmed that RoSPA is to be invited to continue to undertake the annual inspection of the Play Area.

Cllr. Johnston stated that access across the Playing Field is required by a Tree Surgeon to attend to her oak tree. The Clerk commented that he had authorised such access and this decision was endorsed by the Council.

The Clerk reported that Cllr. Biles in a written report had stated that Neville Day will inspect the trees in Westwood Park without charge.

b.       Cllr. Harding reported on behalf of the Open Spaces sub-Committee and stated that some six palings were missing from the Play Area fence and that there appeared to be a new panel on the Arctic Tower.

Environment.

a.       There were no matters reported by the Environmental Sub-Committee.

The Clerk reported that a letter had been received from a parishioner regarding the necessity to clear the ditch alongside Lyefield Lane. The Council discussed this matter but decided to take no action at present.

b.       Cllr. Edwards reported that the Parish Steward had visited and had undertaken a number of tasks, including filling the pothole opposite the shop. He added that there was a lot of moss at The Pastures that needed clearing and that he would speak to Denise Grech about the matter. He added that the next visit was planned for 25 January.

Footpaths.

Cllr. Johnston reported on behalf of the Footpath Sub-Committee and stated that a parishioner had complained of a fallen tree at the back of the Social Club. She added that she, with the assistance of her husband, had cleared it away.

10.     The Queen’s Diamond Jubilee Celebration 2012.

Cllr. Biles in a written report read out by the Clerk stated that forty-two replies had been received from the five hundred or so questionnaires distributed and that the next meeting of the Jubilee Committee is to be held on 27 January after which he would be able to inform the Parish Council of any plans for the Jubilee Celebration.

11.     Neighbourhood Plans.

The Clerk stated that he had written to Wiltshire Council on this subject, as requested, and although he had received two acknowledgements of his letter no formal reply had yet been received.

12.     Valley Parishes Alliance (VPA).

There was nothing reported, except that the next meeting is to be held on 9 February.

13.     Date of Parish Council Meeting.

The Council noted the date of the next Meeting:

VE Memorial Garden – Selwood Housing had contacted him regarding the ownership and nature of this artefact.

Jubilee Oak Tree/ Seat – A parishioner had contacted him enquiring where in the village would be available for a Jubilee Celebration Oak Tree/ Seat.

Localism Bill, Standards/Code of Conduct – The Standards Board of England has been scrapped and Wiltshire Council are preparing new guidelines regarding Code of Conduct/Standards that Parish Councils will be invited to adopt.

Wiltshire Council, Proposed Dog Control Orders – Westwood PC has no need for additional ones.

West Wilts Motor Club, James Cup Trial (12 February 2012) – Cllr. Howard-Evans stated that it has taken almost a year for that area of Becky Addy woods to recover from the previous motorcycle trials. The Clerk was asked to write to the Organising Committee to ask that the area is restored, as far as is practicable, to its original state immediately following the trial.

Pharmaceutical Services – Permission has been granted for The Health Centre to dispense medicines to the former patients of St Margaret’s Surgery.

Cllr. Howard Evans commented that the footpath entrance near to the Bus Stop at Leslie Rise/Bobbin Lane was obscured by vegetation. The Clerk stated that he would ask Mr. Cooke to cut it back.

Good Neighbour Scheme – Cllr. Biles had confirmed that he is awaiting confirmation that the coordinator will address the Parish Council at its meeting on 9 March.

Councillors reported that Messrs. Morris and Stockwell had cleared a route for surface water to drain away that was causing an obstruction on the Lower Westwood road; Mr Morris at the bottom of The Pastures, Mr Stockwell near to Housels Field. The Clerk was asked to write a letter of thanks to both individuals.

The Chairman welcomed everyone to the meeting.

2.       Apologies.

Apologies for non-attendance were received from Parish Councillor Cllr. G Edwards.

3.       Minutes of the Ordinary Parish Council Meeting held on 7 November 2011.

The minutes of this meeting were signed as a true and accurate record.

4.       Adjournment.

The Chairman adjourned the meeting for members of the public to raise any matters of concern and then reconvened the meeting.

5.       Westwood Road Safety.

a.       Cllr. Bishop reported that there had been no further meetings of the Parish Council Road Safety Group. He added that a further Metrocount survey had been expected to commence around 11 November but as this had not happened he stated that he would contact Wiltshire Council.

The Chairman stated that he was pleased to note that Wiltshire Council intends to commence a programme of repairing and resurfacing the ‘C Classification’ roads around Westwood in February/March next year and added that this information should be displayed on the Parish Council noticeboards in the village when the detailed programme has been published.

Cllr. Higgs commented that the stretch of road between Iford Hill and Staples Hill was particularly dangerous for walkers and improved road safety measures there were a necessity. Cllr. Harding added that there were a significant number of potholes at the bottom of Boswell Road that needed attention.

Cllr. Richardson stated that there are a number of steps being taken by Wiltshire Council to improve the road safety and the condition of the roads in and around Westwood, and that some of these proposals had emanated from the Parish Council Road Safety Group. He recommended that clarification is sought from Wiltshire Council regarding the full programme of work intended for Westwood and that such clarification could be obtained from the CATG Meeting to be held on 9 January 2012.

6.       Neighbourhood Policing.

a.       In the absence of a representative from the Neighbourhood Policing Team, no report was given.

b.       Cllr. Richardson commented that he had seen a Police Crime Scene van at the top of Lyefield Lane and police officers examining the surrounding area.

There were no other matters reported.

7.       Bradford on Avon Community Area Board.

a.       A report on the proceedings of the Area Board meeting held on 23 November 2011 was given by Cllr. Biles and a copy of this report is appended to these minutes.

Cllr. Biles highlighted the following matters that were discussed at the Area Board meeting:

·    Westwood Primary School – The school kitchen is now redundant because school meals are cooked off-site and are delivered daily and consideration is being given to converting the kitchen space into an additional room that could be used by the community.

·    The Queen’s Jubilee Celebrations – The Area Board has allocated £10,000 for grants towards the cost of these celebrations. Cllr. Parker suggested that the Westwood Jubilee Celebration Committee should consider applying for a grant now.

·    ‘Good Neighbour Scheme’ – The Area Board is championing a ‘good neighbour scheme’ to provide support to elderly and needy residents in the community. Cllr. Johnston stated that she was familiar with such a scheme and that ‘Link’ and Community First had pioneered such a ‘good neighbour’ scheme. Cllr. Biles was requested to invite the Manager of the ‘Good Neighbour’ scheme to give a presentation at a future Parish Council meeting.

b.       The Clerk reported that he had once again contacted all the rural parishes in the Bradford on Avon Community Area inviting them to express their view about the value and modus operandi of the Area Board and that the responses from the parishes were mixed. He stated that Holt, Staverton and Wingfield parishes were interested in attending a meeting whereas Winsley and Limpley Stoke parish councils were not and that no reply had been received from Monkton Farleigh Parish Council. The Clerk reported the responses received. Cllr. Howard-Evans commented that he believed that some councils had not understood the nature of the concerns expressed by Westwood Parish Council, namely the democratic principle involved. Cllr. Biles observed that the Area Board appeared to have no Terms of Reference or guidelines that determined its modus operandi and councillors questioned whether the Area Board was delivering Value for Money. The council discussed this subject at some length following which it was resolved that the Chairman of the Area Board, Malcolm Hewson, be invited to give a presentation to the Parish Council and to the parishioners of Westwood on the Community Area Board in order to alleviate many of the concerns of the Parish Council and the local community. The Clerk was asked to write to Mr Hewson and to state the main areas of concern so that he was fully briefed and could tailor the presentation for Westwood.

8.       Sub-Committees - Sub-Committee Reports.

Footpaths.

Cllr. Johnston stated that she had spoken to the owner of Housel’s Field and that the problem regarding the manure was now largely resolved. She also remarked that the short length of footpath at Bobbin Lane that leads to the Westwood School Playing field had been resurfaced since her previous visit. She added that following an enquiry she had made she can confirm that the three oak trees outside 39, 46 and 47 Bobbin Lane each have a Tree Preservation Order.

Cllr. Higgs reported that path 19 that leads to the New Inn across adjacent fields was now dangerous to use because of the presence of horses. The Clerk stated that he would contact the Footpath Warden to enquire whether any action could be taken to segregate the horses from the walkers.

Cllr. Harding reported that solar panels had been fitted to a house roof in Lister Grove and enquired whether it required planning permission. The Clerk was asked to contact Wiltshire Council to obtain the planning policy for fitting solar panels.

Cllr. Howard-Evans reported that a large car parking space, including the laying of a hardstanding, had been created along the road towards Staples Hill and queried whether planning permission should have been sought from Wiltshire Council. The Clerk was asked to make enquiries of Wiltshire Council.

Cemetery.

a.       Cllr. Bishop reported on behalf of the Cemetery Sub-Committee and stated that he had nothing to report.

b.       The Clerk stated that he had copied all the recent correspondence on this subject to councillors and that he had nothing additional to report. He commented that Wiltshire Council had now been requested by the Parochial Church Council to fulfil its obligations and to inspect/repair the tombs in the churchyard.

Finance.

a.       The Clerk reported the current financial position – details of which are appended to these minutes.

b.       The Clerk drew the attention of the Parish Council to the Financial Forecast – attached to these minutes – and was informed that this had already been tabled at the previous Parish Council meeting. The Council confirmed that it had resolved that no action need be taken as the finances were in good order.

c.       The Council resolved to make the payments shown under ‘Payments to be authorised’ above.

Open Spaces.

a.       Cllr. Harding reported on behalf of the Open Spaces sub-Committee and added that Cllr. Edwards had provided him with a verbal report for the Parish Council. Cllr. Harding reported that there was a puddle at the Play Area gate within the Play Area. The Clerk stated that he would ask Playforce to recommend a solution and to provide a quotation for undertaking the work. Cllr. Harding commented that the missing bolt – as reported by the RoSPA Safety Report - had not yet been replaced and that some other bolts were also missing. He added that six slats were missing from the Play Area fence and remarked that the grass in the Play Area needs cutting. Cllr. Harding concluded his report by stating that some of the trees in Westwood park appear to be dying. The Council resolved that Neville Day be asked to inspect the trees in the park and to recommend a husbandry programme for them. Cllr. Biles offered to contact Mr Day and to ask him to provide a quotation for undertaking the work.

Cllr. Higgs enquired whether there had ever been any discussion regarding the provision of facilities for teenagers in Westwood. Councillors commented that this had been a subject that was discussed some time ago without any firm conclusions being reached. The Clerk was asked to place it on the Agenda for the Annual Parish meeting.

Environment.

Cllr. Harding reported that as a result of the recent rebuilding of the wall near to the New Inn, the gate to the adjoining well was missing. The Clerk stated that he was unaware of this and that nobody had requested the well gate key from him.

9.       The Queen’s Diamond Jubilee Celebration 2012.

Cllr. Biles stated that some 550 questionnaires had been distributed throughout the village and, by 27 November, he had received forty-two replies. He added that the most popular choices for a Celebration Event were a picnic and a walk/cream tea. He stated that a meeting is to be held at 7.30pm in the Parish Room on 20 January 2012 to agree a programme of events. He added that it was still intended to give all children in the village and at Westwood School a Celebration Mug, although the exact distribution of these had yet to be agreed.

10.     Neighbourhood Plans.

The Clerk stated that the Localism Bill soon to be approved by parliament makes reference to a Neighbourhood Plan that will determine the development of the local community, including its infrastructure. The Clerk explained the background of similar plans, such as Parish Plans and commented that although their production was encouraged by Wiltshire Council and its predecessors, they had no authority in terms of planning or infrastructure decision-making. Cllr. Biles stated that there are many mixed messages being received about the nature and the authority of such a plan and that little guidance appeared to have been produced. The Council noted that Freshford and Limpley Stoke had received funding from Wiltshire Council to produce such a plan for their community and it was likely that other communities were also producing similar such plans. He stated that he believed some guidance on the production of these plans would be produced by Wiltshire Council in the light of experience. Cllr. Richardson stated that such plans needed a framework and structure and Terms of Reference and proposed that a letter be sent to Wiltshire Council seeking guidance and advice on the production of such plans and how they relate to the Community Area Boards. The Council resolved that the Clerk writes such a letter.

11      Valley Parishes Alliance (VPA).

The Chairman stated that he was now the Parish Council representative on the Valley Parishes Alliance. He reported that the Alliance members are addressing a number of issues that have been raised by BANES that include the Kennet and Avon Canal mooring strategy, the Gypsy, Traveller and Showpeople Site Allocation policy and the freezing of already very high car parking charges in Bath.

12.     Date of Parish Council Meeting.

The Council noted the date of the next Meeting:

·         Ordinary Parish Council meeting – Monday 9 January at 7.30pm.

13.     Any Other Business.

The Chairman stated that the Parish Council had received a letter from Mr Parsons at Westwood Stores requesting that it gives consideration to making a grant towards improving the lighting in the shop. The Council asked that this matter be placed on the Agenda for the next meeting.

In reply to a question from Cllr. Johnston, the Clerk stated that the two adverts in the latest issue of the Westwood Update had been placed in that newsletter because they had been inadvertently omitted from the previous edition that carried the adverts for businesses in Westwood. He confirmed that the policy of not accepting commercial advertising remained unchanged.

The Chairman confirmed that the Christmas Meal will go ahead on the 19 December 2011.

The members of the Finance sub-Committee confirmed that there would be no separate sub-Committee meeting prior to the next Parish Council meeting.

Cllr. Richardson suggested that a letter be sent to Wiltshire Council asking it to state its policy with respect to ‘fracking’ in view of the potentially large area of the Mendips and its associated subterranean water courses and aquifers that may be affected if licences are granted.

The Chairman welcomed everyone to the meeting.

3.       Minutes of the Ordinary Parish Council Meeting held on 3 October 2011.

The minutes of this meeting were signed as a true and accurate record.

4.       Adjournment.

The Chairman adjourned the meeting for members of the public to raise any matters of concern and then reconvened the meeting.

5.       Westwood Road Safety.

a.       Cllr. Bishop stated that there had been a meeting of the Parish Council Road Safety Group last week. He reported that the final Metro Count readings are to be taken week commencing 18 November and that the consultation period for parishioners to express their views will take place thereafter. He added that the consultation questionnaire is in preparation and that Wiltshire Council has agreed to finance the community consultation. Cllr. Bishop stated that the next CATG meeting was in early January next year and that would be the opportunity to push forward the proposals for a pedestrian footway at the Iford end of the village along the Lower Westwood Road, between Iford Hill and The Pastures. Cllr. Bishop added that the measured effect, so far, of the 20 mph trial is that the average speed of motor vehicles has been reduced by around 2 – 3 mph and the earlier greater average speed reduction had not been maintained. He concluded his report by summarising the various road safety measures that had been supported by the CATG for both Westwood Parish Council and Wingfield Parish Council, subject to agreement by both councils and commensurate financial contributions. The road safety measures proposed for Westwood were:

·    A virtual pavement between Lyefield Lane and The New Inn, with lengths of the the pavement on both sides of the road – initially on the north side of Lower Westwood road from Lyefield Lane and crossing to the other side just prior to the row of cottages at 86 Lower Westwood (approximately).

·    Signage indicating the pedestrian use of the Virtual Pavement.

·    Single Lane road signage and markings at the ‘pinch-point, (Rose Cottage/Orchard Close).

·    Refreshing existing road markings/white lining.

Cllr. Howard-Evans stated that there was a need for the road surface to be repaired first and for a renewal, or repair, of the existing surface water drainage system before a virtual pavement is painted on to the road. Cllr. Parker confirmed that Wiltshire Council will be repairing the road before the road safety measures work commences but that this would not include a full resurfacing of Lower Westwood road.

The Council noted that the proposed questionnaire was being prepared with the assistance of PC Barrett.

b.       The Council noted that the CATG Community Grant application had been successful and that a vote on whether to proceed with the ‘Road Safety Initiatives’ should now be taken.

c.       The Council resolved by a majority that Wiltshire Council is to be asked to implement the following road safety measures:

·    A virtual pavement between Lyefield Lane and The New Inn

·    Signage indicating the pedestrian use of the Virtual Pavement.

·    Single Lane road signage and markings at the ‘pinch-point, (Rose Cottage/Orchard Close).

·    Refreshing existing road markings/white lining.

d.       The Chairman stated that the estimated cost of the Westwood and Wingfield road safety measures was £14786 and Wiltshire Council had declared that whilst it would provide most of this finance there was a shortfall of £1161, based on the estimated costs, that had to be shared between Westwood and Wingfield Parish Councils and that without this shortfall being met the road safety measures could not proceed. There ensued a discussion on the best way to apportion the respective shares of the two parish councils and following a proposal from the floor, the Parish Council resolved to contribute fifty percent towards the shortfall whilst acknowledging that fifty percent of the final, not estimated, cost may slightly increase the contribution made by Westwood Parish Council.

6.       Neighbourhood Policing.

a.       PC Barrett reported that there had been two attempted  break-ins into commercial premises at Upper Westwood but following swift action by the public and the police, including the use of the police helicopter, an arrest had been made.

b.       In response to a question from the Council, PC Barrett stated that in view of the general reduction in speed of traffic passing through Westwood, the 20 mph trial must be considered a success.

There were no other matters reported.

7.       Bradford on Avon Community Area Board.

a.       There were no matters that the Council wished to report to the Area Board at its meeting on 23 November 2011.

b.       The Clerk reported that he had contacted all the rural parishes in the Bradford on Avon Community Area inviting them to express their view about the value and modus operandi of the Area Board and any concerns they may have regarding the development of a ‘Neighbourhood Plan’. The councils were also invited to a meeting if there was sufficient interest. He commented that, to date, he had only received two replies – one from Winsley Parish Council and one from Holt Parish Council. The former had stated that it was not in a position to express a view since the Council was a new one and unfamiliar with the Area Board; the latter had expressed an interest in attending such a meeting.

The Clerk was asked to resend the message to the remaining councils in case the earlier message had been missed, although the Chairman observed that the other Parish Councils may not have had their respective Parish Council meetings yet in order to formulate a response.

Cemetery.

a.       Cllr. Bishop reported on behalf of the Cemetery Sub-Committee and stated that he had nothing to report.

b.       The Clerk stated that the Parochial Church Council had written to Wiltshire Council requesting it to undertake the repair/cleaning work to be undertaken on the tombs following the historical correspondence received by the PCC confirming that the predecessor of Wiltshire Council, namely West Wiltshire District Council, had accepted responsibility for the tombs. The Clerk reported that a reply to this correspondence is awaited and when received should make the position regarding respective responsibilities for the closed churchyard clearer.

Finance.

a.       The Clerk reported the current financial position – details of which are shown on the last page of these minutes.       

b.       The Clerk stated that Westwood Parish Council is now registered as an employer with HMRC.

Clerk’s Note.

Westwood PC is now registered with HMRC as an Employer, in accordance with current legislation. It has one employee – the Clerk, Mr R P Coleman with an Employee No. of West 01. The Employer PAYE Reference is: 475/YA63331

b.       The Clerk tabled the RoSPA Annual Safety Inspection Report and stated that the only item of concern stated in the report related to a missing bolt on the Antarctic Iceberg Tower. Cllr. Edwards stated that he would attend to this matter.

Cllr. Harding confirmed that the fence palings were still missing. The Clerk was asked to write to Mr Say asking him to repair the fence and to send an invoice for any expenditure incurred to the Parish Council.

Environment.

The Clerk stated that a parishioner had complained about the trees that were on Parish Council land that adjoined the footway leading into the school playing field from the end of Bobbin Lane. The Clerk and Cllr. Johnston each stated that they had inspected the trees and did not see any immediate cause for concern, although there was some evidence of the tree roots possibly affecting the footway surface. Cllr. Howard-Evans commented that there was a manhole cover nearby and it was possible that the roots could cause damage to that chamber. Cllrs. Edwards and Howard-Evans agreed to inspect the trees and the immediate area and to report back to the Parish Council for it to determine what action, if any, should be taken.

Cllr. Edwards reported that he had taken photographs of the potholes at Staples Hill and that he intended sending these to Wiltshire Council with a request that action is taken to repair them.

Cllr. Bishop reported that Mrs Jordan had contacted him to advise him that the oak tree on her land is to receive attention and that access to the tree will require the contractor to have access to the playing field.

Footpaths.

Cllr. Johnston reported that Path 14 (opposite Orchard Close to Farleigh Lane and passing through Haygrove Farm) had now been cleared.

Cllr. Johnston reported that manure is being deposited on the bridleway (Path 19) and that the person renting the adjacent field from the owner of Housel’s Field appear to be the culprit. Cllr. Johnston stated that she would speak to the owner of Housel’s Field.

9.       The Queen’s Diamond Jubilee Celebration 2012.

Cllr. Biles stated that a meeting on this subject was held on 12 October. He stated that a ‘flyer’ is to be send to all households in the Parish to see if there would be sufficient support for celebration activities to be held. He added that some 550 flyers would be required and he would be seeking financial support from the Parish Council to meet this cost.

10.     The Pre-Olympics Sports Festival.

The Council resolved not to participate.

11      Valley Parishes Alliance (VPA).

The Chairman stated that he would attend the next meeting of the Valley Parishes Alliance if he was available.

12.     Date of Parish Council Meeting.

The Council noted the date of the next Meeting:

13.     Any Other Business.

The Chairman confirmed that the Christmas Meal will go ahead on the 19 December and councillors agreed that Mr & Mrs Say should be invited as guests in recognition of the voluntary work Mr Say undertakes for the community – especially in relation to the Play area.

Cllr. Bishop confirmed that the Road Safety Questionnaire to go round the village is being prepared by the Road Safety Group based on the proposals by Cllr. Parker.

5.       Westwood Road Safety.

a.       Cllr. Bishop confirmed that the data from the latest Metrocount had been received but that there was nothing else significant to report. He added that a parishioner, Chris Humphries, had requested that the Parish Council arrange a meeting with Wiltshire Council that he could also attend in order to review the progress of the ‘20 mph’ Trial. Cllr. Bishop added that he would arrange such a meeting. In respect of the proposed Virtual Pavement, Cllr. Johnston commented that the one at Limpley Stoke had become very indistinct and that a simple white line might be just as effective and considerably cheaper. The general view of the Council was that there was a need for some form of Virtual Pavement between Lyefield Lane and the New Inn and Cllr. Richardson stressed that the emphasis should be on an effective solution that will give some protection to pedestrians and that there may be alternatives to the traditionally painted road surface. Cllr. Richardson stated that he would be attending the CATG Meeting on 7 October and that he had noted the views of the Council and would represent those views at that meeting. He added that some priority should be given by the CATG to this project in view of the proposal by the Parish Council to make a significant financial contribution towards it. The Council resolved that Cllr. Richardson would represent the Parish Council at that meeting.

b.       The Council noted that Wiltshire Council had, apparently, already decided on a number of the questions to be posed in the questionnaire, although these had not been communicated to the Parish Council. The Parish Council also queried the timescale for such a questionnaire to be distributed to parishioners and the method by which Wiltshire Council was intending to distribute them. Cllr. Edwards suggested that Limpley Stoke Parish Council should also be consulted because they, too, would have had to propose questions for their ‘20 mph Trial’ questionnaire. Cllr. Richardson stated that he would ask the CATG Meeting for sight of the questions and would also raise the other points to obtain clarification, especially details of the timescales for the consultation process.

c.       Cllr. Biles advised the Council that the grant application would be determined by the CATG and not the Area Board and that it was to be discussed at the CATG Meeting on 7 October. Cllr. Richardson commented that the rules for the grant application appear to have changed yet again and that he would also pursue this matter at the CATG Meeting.

6.       Neighbourhood Policing.

a.       In the absence of a representative from the Neighbourhood Policing Team (NPT), no report was given.

b.       Cllr. Harding reported that there may be an abandoned car at Boswell Road. Cllr. Johnston stated that she would advise the police on the new 101 number.

There were no other matters reported.

7.       Bradford on Avon Community Area Board.

a.       Cllr. Biles reported that he had attended the Area Board held on 21 September and had sent a written report of that meeting to all councillors. He stated that the proposed ‘Lorry Watch’ scheme was discussed at some length and he circulated maps to councillors showing the proposed ‘lorry routes’ following the imposition of the Weight Restrictions at Cleveland Bridge, Bath. He added that the purpose of ‘Lorry Watch’ was to deter lorry drivers from ignoring the weight restrictions that are present on many local roads, including the one imposed on Bradford on Avon Town Bridge. He commented that, curiously, if someone spots a lorry that clearly exceeded the weight limit then it has to be reported to Wiltshire Council, Trading Standards and not the police. Cllr. Howard-Evans observed that the use of vehicle number recognition technology and CCTV at key locations would prove more effective.

b.       Councillors expressed their disappointment with the Area Board, describing it as ineffective and as a ‘talking shop’ that was largely dominated by self interest groups who appeared able to control the agenda. Cllrs. Howard-Evans and Richardson commented that the Area Board appeared unable to make decisions on a very wide range of issues and decisions that were made rarely addressed the concerns of the wider community – especially the villages.

The Clerk commented that he was aware of a general disquiet from other parishes regarding the effectiveness or role of the Area Boards and that in his view Parish Councils needed to protect the democratic principle that it is the Parish Council and Wiltshire Council who are the democratically elected bodies and not the Area Boards.

A general discussion ensued and the Council resolved to consult with other Parish Councils in the Bradford on Avon Community Area to gauge their views and, if necessary, to make representations to Wiltshire Council. The Clerk was asked to make the necessary arrangements for the Chairs of the relevant parishes to communicate their views. Cllr. Biles stated that he would discuss this subject with his fellow members of the Community Area Grants Advisory Committee at the forthcoming meeting.

The Clerk commented that in view of the proposed Localism Bill that would encourage the creation of a Neighbourhood Plan that would describe how communities wished their neighbourhoods to develop, it was essential that the views of the parishes were included in such a plan. He added that he was fearful that if a Neighbourhood Plan was developed by the Bradford on Avon Community Area it may prove to be ‘town centric’ with little consideration given to the rural communities. The Chairman stated that this would also be a useful topic to discuss with the Chairs of the other Parish Councils. Cllr. Richardson offered to contribute to this meeting, if requested.

8.       Sub-Committees - Sub-Committee Reports.

Footpaths.

The following matters were reported by Cllr. Johnston on behalf of the Footpath Sub-Committee:

Path 12 (at its junction with the Lower Westwood Road) – This path had now been cleared by an adjoining land owner.

Path 16 (The Pastures to the Upper Westwood Road) – Overgrown vegetation to be cut back. The Clerk was asked to request Mr Cooke to undertake this task.

Path 26 (Upper Westwood to Avoncliff) – The overgrown vegetation has now been cut back and the tree branch has been removed. Cllr. Higgs stated that she had spoken to the land owner across whose land the path runs and that she had been very helpful and co-operative.

Cemetery.

a.       Cllr. Bishop reported on behalf of the Cemetery Sub-Committee and stated that the cemetery appeared in good order. The Clerk stated that he had now received a new Register of Purchased Graves and a Register of Burials.

b.       The Clerk stated that he intended discussing the matter of the closed churchyard with the churchwardens following the recent quinquennial inspection of the church and churchyard that had identified that some of the tombs needed cleaning. He commented that he would be taking a cautious approach when resolving the matter of the Cemetery Grant and was keen, initially, to receive confirmation that Wiltshire Council (previously West Wiltshire District Council) did have responsibility for maintaining the tombs.
